The purpose of this academic article is to analyze the normative element “judicial or administrative case“ of the criminal type of influence peddling, which has been the subject of several interpretations in both doctrine and jurisprudence. To address the proposed objective, the academic article will be divided into three chapters. The first section analyses the criminal nature of the offence, the evolution of regulations, the protected legal asset and the elements of the objective type. In the second, after a review by international instruments, comparative legislation and national jurisprudence, an interpretation of the element “judicial or administrative case“ is proposed. The third explains the principle of criminal legality and the teleological interpretation of the normative element. Finally, it is concluded that the interpretation of the element “judicial or administrative case“ should be broad. Thus, “judicial case“ should include not only the judicial processes, but also those prior to this (police and fiscal investigation), while “administrative case“ should be understood as an administrative procedure. The methodology used is based on the revision of dogmatic concepts, the principles of criminal and constitutional law, as well as the concepts of administrative and procedural law; to this end, national and international doctrine was used, as well as the jurisprudence issued by the judiciary and the Constitutional Court.
