The case under analysis of this legal report occurs within the framework of the signing of Contract No. 003-2018-IN/OGIN for supervision between the Bravajal Consortium and MININTER for the work: “Expansion of the Services of the Iquitos Higher Technical School of the National Police of Peru – First Stage“. This contract was produced with the intention of continuing the supervision service; since the MININTER had terminated the contract of the previous supervisor. It is in such a contractual relationship that events immersed in legal institutions arise, such as the termination of the contract, declaration of nullity ex officio, extensions of the term, breach of essential obligations. Therefore, this report aims to analyze whether, on the one hand, the resolution made by the contractor was followed in accordance with the procedure provided for in the regulatory framework of state contracting. For its part, it will also be questioned whether the declaration of nullity ex officio for the alleged transgression of the principle of presumption of veracity promoted by the Entity was in accordance with the Law of Contracting with the State in accordance with the Law of General Administrative Procedure. Finally, the report covers the analysis of the term extensions to supervision contracts No. 03 and No. 04; and, if the non-payment of such benefits should be classified as a breach of essential obligation. Which, in turn, would enable the Contractor, according to the regulatory framework of State Contracting, to proceed to terminate the contract based on such cause.
