La procedencia del pago por la segunda entrega del producto papilla a la empresa CONSORCIO DE ALIMENTOS S.A.C. en el marco de la ejecución del Contrato N° 10-2012-MIDIS-PRONAA

Abstract

En el presente informe, se analizará la procedencia del pago por la segunda entrega del producto papilla en el marco de la ejecución del Contrato N° 10-2012-MIDIS-PRONAA y su Primera Adenda, objeto de controversia en el proceso arbitral seguido entre la empresa Consorcio de Alimentos S.A.C. y el Programa Nacional de Asistencia Alimentaria. En esta oportunidad, se verificará si se cumplió con el procedimiento adecuado de recepción y conformidad y si las penalidades por mora y otras penalidades fueron aplicadas correctamente de acuerdo al mencionado contrato y la normativa de Contrataciones del Estado aplicable. Como conclusión, se determinó que el pago por la segunda entrega del mencionado producto no resulta procedente, pues no se cumple con los requisitos establecidos en el mencionado contrato y la normativa aplicable.

In this report, the feasibility of the payment for the second delivery of the baby food will be analyzed during the execution of Contract N° 10-2012-MIDIS-PRONAA and its First Addendum, object of arbitration controversy in the arbitration process followed between the company Consorcio de Alimentos S.A.C. and the Programa Nacional de Asistencia Alimentaria. On this occasion, it will be verified whether the appropriate reception and conformity procedure was followed and whether the penalties for late payment and other penalties were applied correctly in accordance with the aforementioned contract and the applicable rules. In conclusion, it was determined that the payment for the second delivery of the baby food is not appropriate, because the requirements established in the aforementioned contract and the applicable rules were not accomplished.
