The report analyzes the interpretation procedure of the numeral 2, Annex 11 of the Jorge Chávez International Airport Concession Contract guided by OSITRAN between the years 2005 and 2009 with the purpose of providing interpretation parameters that allow to solve this type of controversies in an efficient and legally correct way; and also, to identify the harmful effects of an inconsistent and incongruous OSITRAN proceeding in this type of procedures. For this, we identify the regulation related to concession contracts and the interpretation procedure, the pertinent methods of interpretation that can apply for the resolution of the controversy and a critical analysis of the OSITRAN proceeding. It includes the study of the concessions and Public-Private Associations regulation, the Civil Code, the State Assets regulation, and the interpretation procedure rules both in the sectoral regulation and in the General Administrative Procedure Law. The report concludes that the interpretation of a concession contract must follow a particular legal structure in relation to our current regulation so it prevents future discrepancies regarding the understanding of certain contractual content, and also that OSITRAN did not proceed in accordance with the law.
