The constitutional right to free private initiative, business freedom and free competition are not unlimited, while the exercise of said rights must not contravene the public interest; For this reason, it is necessary that the public administration, in function of the administrative police, establish measures such as requirements, prohibitions, collections, etc. legal and reasonable, in order to protect the general interests of the company. However, the entities of the administrations do not carry out an adequate analysis of the regulatory impact, which is why the economic agents are affected in terms of access and permanence in the market. However, the regulation for the elimination of bureaucratic barriers has been in constant change. Legislative Decree No. 1256 repealed Article 26 Bis of Decree Law No. 25868 and was published at the end of 2016. The purpose of this regulation was to strengthen Indecopi's powers. One of the novelties was the scope of the non-application with general effects of those Resolutions that declare illegal bureaucratic barriers materialized in administrative provisions; However, in the explanatory statement, it does not reflect an adequate justification regarding the exclusion of unreasonable Barriers, since in the latter the effects will fall solely on the complaining party and not on the others who are affected by the disputed measure. In this sense, the purpose of this report is to demonstrate and propose the feasibility of non-application with general effects on unreasonable bureaucratic barriers materialized solely in administrative provisions. For this, the first chapter will deal with the current regulation of Legislative Decree No. 1256 and in the second chapter the analysis of the non- application with particular and general effects of illegal bureaucratic barriers and care of reasonableness regarding Bill No. 500-2021-CR.
