The main objective of this study is to analyze whether the interpretation made by the Antitrust Chamber No. 2 in Resolution No. 2221-2012/SC2-INDECOPI dated July 19, 2012, regarding the duty of suitability, regulated in the current Consumer Code, is correct. Likewise, this research seeks to identify the role that guarantees have in the duty of suitability analysis and whether the legal remedies regulated in consumer protection law should be residual. In that sense, to achieve the objectives proposed in this study, a review and theoretical analysis of different sources of information has been made. The research points out that the duty of suitability must be performed considering the due supplier performance of the product warranty and addresses the reasons why legal remedies are not and should not be residual. Finally, it is concluded that the Antitrust Chamber No. 2 made a correct interpretation of the configuration of the suitability duty in Resolution No. 2221-2012/SC2-INDECOPI.
