Abstract: El presente informe analizará la Resolución Nº 735-2022/SPC-INDECOPI, donde se resuelve
la controversia entre una mujer trans1 y Altek Trading S.A.C.2 e Inmuebles Panamericana
S.A.C.3
, mediante la cual la Sala de Protección al Consumidor del Indecopi realiza un cambio
de criterio respecto al uso de baños por parte de personas trans, favoreciendo a la identidad de
género de la administrada.
Revisaremos dos aspectos de la decisión a la Sala –(i) los requisitos para la constitución de un
acto de discriminación y (ii) la determinación de obligaciones para el proveedor a partir de
sus conductas- para verificar si la resolución es un avance en el reconocimiento de derechos
fundamentales a través de la protección al consumidor. Para ello, se debe revisar el marco
legal de los derechos fundamentales de las personas trans; pero, a diferencia del análisis de la
Sala, nos concentraremos en el reconocimiento nacional de estos, a través de tratados
vinculantes y jurisprudencia constitucional.
Con esas premisas, veremos cómo, en este caso, no era necesaria la evaluación de una
justificación objetiva para determinar la constitución de un acto de discriminación; y que el
proveedor, luego de cierto tiempo de adoptar una actitud a favor del consumidor, mantiene
una obligación de continuar dicha actitud.
The present paper will analyze Resolution Nº 735-2022/SPC-INDECOPI, which resolves the controversy between a trans woman and Altek Trading S.A.C. and Inmuebles Panamericana S.A.C., through which the Superior Tribunal of Consumer Protection of Indecopi makes a change in criteria regarding the bathroom use of trans people, benefitting Claimant’s right of gender identity. We will revise two aspects of the Tribunal decision –(i) the requirements of the constitution of an act of discrimination and (ii) the constitution of obligations for the provider from its own actions- in order to verify if the resolution is an advance on the recognition of fundamental rights through consumer protection. For that purpose, we shall revise the legal frame of trans people fundamental rights; but, unlike the Tribunal, we will focus on their national recognition, through bonding international treaties and constitutional jurisprudence. With said premises, we will see how, in this case, it was not necessary to evaluate the existence of an objective justification to determine the constitution of an act of discrimination; and that the provider, after adopting a conduct in favor of the consumer for some time, will have an obligation to continue said conduct
