This legal report analyzes the resolution issued by the Specialized Chamber for the Defense of Competition of INDECOPI through Resolution 0115-2023/SDC-, where it rules on the complaint filed by Aris Industrial S.A., against Importaciones Bio E.I.R.L. for allegedly committing violations to Legislative Decree 1044, also known as Law for the Repression of Unfair Competition. In particular, due to the fact that the conduct of Importaciones Bio E.I.R.L. in the framework of a Public Bidding, could represent a violation of the unfair competition regulations, since it would have allegedly committed acts of deception and acts of regulatory infringement. However, the main objective of this report is to determine whether the administrative authority in second instance carried out a congruent and lawful work, regarding the analysis of the infringing type of acts of deception. Well, the complaint referring to the commission of fraudulent acts with respect to the conduct of Importaciones Bio E.I.R.L. was declared null and void in that sense, so it was not analyzed by INDECOPI. Thus, this work is justified by the complexity that may exist with respect to the work of classification of infringements carried out by the administrative authority, and how, by virtue of the latter, the authority can correctly analyze the behavior of the defendants and, by virtue thereof, avoid any affectation to the market in line with the unfair competition regulations.
