Abstract: El presente informe analiza la Resolución N° 1976-2023/SPC-INDECOPI, donde
se resuelve la denuncia administrativa presentada por la Sra. Catalina Ramos
contra la Congregación de Religiosas Reparadoras del Sagrado Corazón de
Jesús. Al haber contratado los servicios educativos de dicha institución para su
hija, una estudiante con discapacidad que cursó el primer grado de secundaria
en el establecimiento de la denunciada. La controversia versa sobre las
infracciones al deber de información, idoneidad y discriminación contenidos en
el Código de protección y defensa del consumidor.
El análisis iniciará con el desarrollo del contenido del derecho a la educación
inclusiva a la luz del modelo social de la discapacidad. Se revisará e interpretarán
las normas sectoriales desde el modelo social de la discapacidad con el objetivo
de dotar de contenido al deber de idoneidad y la garantía de la no discriminación.
Se buscará argumentar que una correcta interpretación es necesaria para la
tutela del derecho a la educación, el cual tiene una relevante protección
constitucional.
Finalmente, se evaluará la importancia de la coherencia del fallo de la Sala con
relación a lo resuelto sobre la infracción al deber de información. Además de
acotar la importancia del carácter oportuno y detallado del deber de información
en la protección al consumidor.
This report analyzes Resolution No. 1976-2023/SPC-INDECOPI, which resolves the administrative claim made by Mrs. Catalina Ramos against the Congración de religiosas reparadoras del Sagrado Corazón de Jesús. After having contracted the educational services of the mentioned institution for her daughter,a disabled student who attended the first grade of high school in the institution of the accused. The controversy is about the violations to the duty of information, adequacy and discrimination contained in the code of protection and defense of the consumer of Perú. The analysis will begin with the development of the content of the right to inclusive education in light of the social model of disability. The specific norms will be reviewed and interpreted from the social model of disability with the intention of providing content to the duty of adequacy and the guarantee of nondiscrimination. It will be argued that a correct interpretation is necessary for the protection of the right to education, which has a relevant constitutional protection. Finally, the importance of the coherence of the INDECOPI´s decision in relation to the judgment on the violation of the right to information will be evaluated. In addition, the importance of the opportune and detailed nature of the right to provide information in consumer protection will also be discussed.
