How does the dismissal procedure manifest the employee's right of defense? Is the right of defense really guaranteed in the procedure of capability dismissal? Is there a need to reinterpret or reformulate the procedure of capability dismissal? Which is the protection for the employee whose right of defence is violated? The author addresses these questions on the basis of an analysis about how the right of defense and its manifestations or restrictions are satisfied in the procedure of capability dismissal. Thus, he intends to demonstrate the impossibility of the worker to exercise the right of defense in this type of dismissal procedure. To achieve this, he establishes the constitutional and international importance of the exercise of the right of defense in a dismissal procedure as an expression of the right to due process. Furthermore, he calls into question the efficacy of mechanisms established in the procedure for dismissal on the grounds of incapacity relating to the remedying of the worker's diminished capacity. In addition, he reflects on the limits of interpretation of the current and confusing regulation of dismissal procedures and postulates the reformulation of the procedure for dismissal on grounds of capability. Finally, he points out the suitable means of protection for the worker whose right to defense has been violated.
