Consumer protection law is based on the protection of consumers in a scenario in which the economic imbalance and information asymmetry inherent in market dynamics can lead to harm in their economic and personal sphere. In banking activity, the particular complexity of its operations amplifies this imbalance in the consumption ratio, exposing the banking consumer to a situation of greater vulnerability. Therefore, this paper aims to evaluate the effectiveness of the peruvian legal system of consumer protection of products and services of credit institutions. For this purpose, from a dogmatic, legislative and jurisprudential perspective, the scope and particularities that make up the banking consumer are outlined and their differentiation is established with respect to the common category of consumer protected by the Código de Protección y Defensa del Consumidor. On the other hand, the specific regulation aimed at protecting the rights of the financial consumer and the institutional design of the competent entities in this area is developed: the Instituto Nacional de Defensa de la Competencia y de la Protección de la Propiedad Intelectual and the Superintendencia de Banca, Seguros y AFP. In addition, the implemetation of private self regulation initiatives such as those implemented by ASBANC is evaluated. Thus, base on a descriptive conceptual framework composed of doctrine, jurisprudence and relevant legislation on the subject, from a descriptive and critical approach, a detailed diagnosis of consumer regulation of financial credit institution’s products and services and consumer complaint and resolution mechanisms is sought, for the purpose of assessing whether the provisions in this área resolve mosto f the conflicts arising from transactions and operations in the banking sector.
