The purpose of this research is to analyze the protection against dismissal of management and trust workers of the private labor regime. At present, the national jurisprudence has been inclined to conclude that this type of workers, if they have occupied a position of such qualification since the beginning of their work, do not have a protection (neither compensatory nor restitutionary) against dismissal. However, according to the legal system, this class of workers is not excluded from the right to work and, therefore, neither from the right to protection against dismissal. In view of the above, the work argues that the current jurisprudential trend (not granting compensation for arbitrary dismissal to workers in positions of management and trust) violates the principle of progressive social rights. It also determines that the withdrawal of trust is a subjective cause of dismissal that can sometimes violate the fundamental rights of the worker (in addition to the right to work) as in the case of a pregnant person. Finally, it concludes that management and workers in positions of trust have a right to compensation that must be vindicated.
