The present research work aims to determine to what extent the new Telework Law and its regulations solve the issue of teleworked overtime. For this purpose, empirical legal research was conducted, using a qualitative and descriptive-interpretive approach design, which included expert interviews, as well as documentary analysis reviewing national, regional, and international regulations, case law, and doctrine. The results indicate that although the Telework Law and its regulations have a positive effect on teleworking, as they recognize the right of workers to receive compensation for the overtime worked remotely, they currently do not offer effective mechanisms for the recognition of overtime hours.
