Consecuencias jurídico penales que originan las rondas urbanas de Cajamarca al ejercer sus funciones en los años 2014, 2017 y 2021

Abstract

Esta investigación tuvo como propósito identificar las consecuencias jurídicas penales que originan las rondas urbanas de Cajamarca al excederse en el ejercicio de sus funciones prescritas por el artículo 1 de la Ordenanza Municipal n.° 229-CMPC en los años 2014, 2017 y 2021. El presente trabajo de investigación jurídica es de tipo básico, diseño no experimental, de alcance descriptivo y enfoque cualitativo, realizado por medio del análisis documental para la recolección y análisis de los datos de las disposiciones fiscales emitidas por el Ministerio Público de Cajamarca en el año 2014 y las sentencias emitidas por la Corte Superior de Justicia de Cajamarca, relacionadas con las consecuencias que originan los ronderos urbanos al excederse en el ejercicio de sus funciones en la ciudad de Cajamarca De los resultados se tiene que las rondas urbanas de Cajamarca se exceden en el ejercicio de sus funciones, generando consecuencias jurídico penales como: i) apertura de investigación penal contra los ronderos por la presunta comisión del delito de lesiones leves, ii) comisión del delito de coacción, y iii) comisión del delito de secuestro.

The purpose of this investigation was to identify the criminal legal consequences originated by the urban patrols of Cajamarca when exceeding in the exercise of their functions prescribed by Article 1 of Municipal Ordinance no. 229-CMPC in the years 2014, 2017 and 2021. This legal research work is of a basic type, non-experimental design, descriptive scope and qualitative approach carried out through documentary analysis for the collection and analysis of the data of the fiscal provisions issued by the Public Ministry of Cajamarca in 2014 and the judgments issued by the Superior Court of Justice of Cajamarca, related to the consequences that originate the urban patrolmen by exceeding the exercise of their functions in the city of Cajamarca. The results show that the urban patrols of Cajamarca exceed in the exercise of their functions, generating criminal legal consequences such as: i) opening a criminal investigation against the patrols for the alleged commission of the crime of minor injuries, ii) commission of the crime of coercion, and iii) commission of the crime of kidnapping.
