Abstract

En los últimos años, los estados y organismos internacionales han venido generando acciones con el objetivo de desarrollar e implementar políticas públicas, para la erradicación de la informalidad y la pobreza. La presente investigación tiene como objetivo, determinar la eficacia de los centros de desarrollo empresarial (CDE) del programa TU Empresa, para facilitar la constitución de la Micro y Pequeña Empresa (MYPE). La metodología empleada es: estudio de tipo cualitativo, con enfoque fenomenológico. Se realizó una entrevista formulada por cinco preguntas semiestructuradas dirigidos a abogados expertos en derecho empresarial. Se obtuvo como resultados que los Centros de Desarrollo Empresarial de referido programa no son eficaces en la constitución de Micro y Pequeña Empresa, se requiere eliminar los formatos en el acto constitutivo que utilizan los CDE. El Decreto Legislativo N° 1332 debería permitir el uso de dos razones sociales o denominaciones iguales. El CDE debe prescindir de la participación notarial. Se tuvo como conclusión que se requiere una mayor organización de los CDE del programa nacional Tu Empresa, para que sean eficaces en la constitución de las MYPEs; el DL N°1332 no han logrado los objetivos esperados de superar las barreas burocráticas., tampoco cumple con las expectivas y con respecto a innovaciones del DL N° 1332, se sugiere permitir el uso de dos razones sociales o denominaciones iguales.

In recent years, states and international organizations have been generating actions with the objective of developing and implementing public policies for the eradication of informality and poverty. The objective of this research is to determine the effectiveness of the business development centers (CDE) of the TU Empresa program, to facilitate the constitution of Micro and Small Enterprises (MYPE). The methodology used is: a qualitative study, with a phenomenological approach. An interview formulated by five semi-structured questions addressed to expert lawyers in business law was carried out. It was obtained as results that the Business Development Centers of the aforementioned program are not effective in the constitution of Micro and Small Enterprises, it is necessary to eliminate the formats in the constitutive act that the CDE use. Legislative Decree No. 1332 should allow the use of two company names or the same names. The CDE must dispense with notarial participation. It was concluded that a greater organization of the CDEs of the national Tu Empresa program is required, so that they are effective in the constitution of MYPEs; DL No. 1332 has not achieved the expected objectives of overcoming bureaucratic barriers. It also does not meet expectations and with respect to innovations in DL No. 1332, it is suggested to allow the use of two corporate names or the same denominations.
