Abstract: RESUMEN
La Economía Colaborativa está revolucionando los distintos sectores en los que incursionan sus
plataformas, a través del uso de la tecnología, se están ideando nuevos modelos de negocios que
poco a poco van consolidándose en el mercado y ganando millones de adeptos a nivel mundial.
Estas plataformas generan múltiples beneficios para los consumidores y optimizan el uso de los
recursos. Sin embargo, también generan múltiples dudas acerca de las regulaciones que les
deben ser aplicadas, los regímenes laborales en los que podrían encajar sus “colaboradores”, las
ventajas que obtienen frente a sus competidores tradicionales al no estar sujetos a las mismas
obligaciones, y el tratamiento fiscal que se les debería brindar en los distintos países en los que
operan.
Por estas razones, el presente trabajo de investigación se propone identificar los problemas
jurídicos que podrían generar las plataformas basadas en la economía colaborativa que vienen
operando en el Perú, a través de una comparación con los problemas que se han identificado en el
extranjero, las medidas legislativas que se están adoptando en otros países, los pronunciamientos
tanto judiciales como administrativos que han merecido estas plataformas alrededor del mundo y
las posiciones doctrinarias que han surgido al respecto.
De esta forma, podremos anticiparnos a posibles problemas jurídicos que podrían ocurrir en
nuestro país, y analizar las mejores alternativas de solución que podrían ofrecerse desde el punto
de vista jurídico, a fin de no entorpecer el desarrollo de estas alternativas empresariales, y
brindarles seguridad jurídica y un entorno adecuado que propicie su desenvolvimiento armónico
con sus competidores, usuarios y el Estado.
ABSTRACT The Sharing Economy is revolutionizing the way that start-ups are starting their business models through the use of technology. People are thinking of new business models that are gradually consolidated in the market and gaining millions of followers worldwide. These platforms generate multiple benefits for consumers and optimize the use of resources. However, they also generate many doubts about the regulations that must be applied to them, labor regimes in which they might fit their “collaborators“, the advantages that they get in comparison to their traditional competitors who do not have the same obligations, and the tax treatment to which they should be subject to in the different countries in which they operate. For these reasons, this research project has the purpose of identifying possible legal problems that could be generated by platforms in the sharing economy that have been operating in Peru, through a comparison with the problems that have been identified abroad, legislative measures being taken in other countries, administrative and judicial decisions that have allowed these platforms around the world to exist and academic positions that have emerged to study it. In this way, we can anticipate possible legal problems that might occur in our country and analyze the best alternative solutions that could be offered from the legal point of view in order not to hinder the development of these business alternatives and to provide legal certainty and a suitable surrounding environment to their harmonious development with their competitors, customers and the state.
