Couples with infertility problems, as part of their treatment, cryopreserve their reproductive gametes or embryos in specialized centers. When the future father dies and the assisted reproduction treatment has not yet concluded, the surviving spouse must decide whether to continue with the process or stop it. In this research work, an analysis is made regarding the right to conceive post mortem of the surviving spouse through assisted reproductive techniques and its incidence on the inheritance law in Peru. The theoretical framework is divided into chapters, in which topics such as: The conceived, assisted reproduction techniques, in vitro fertilization, inheritance law in Peru, regulation on assisted reproduction techniques, and comparative legislation on the right to conceive post mortem have been reviewed and developed. Likewise, through interviews with specialists in civil law, inheritance law and family prosecutors, it has been possible to contrast their opinions with comparative legislation and existing doctrine, establishing the necessary basis for its subsequent regulation, in order to avoid infringement of the right to conceive and inheritance, affecting the mother and the child born as a result of these techniques.
