This study addressed a topic whose context is complicated, since it arises from the fact of the definitive separation or estrangement between parents, after which it is common for disagreements to arise regarding the custody of minor children; posing the present investigation, whose problem refers to how social, technical and legal factors influence determining the possession of minors in the Family Courts of Lima in 2021?, with the objective of developing the analysis of how the factors influence social, technical and legal to determine the possession of minors in the Family Courts of Lima in 2021. In this sense, the methodology that will be applied according to the purpose of the investigation will correspond to the basic type, with a descriptive level, of qualitative approach and phenomenological design, considering a population made up of lawyers specialized in family law, and sentences handed down in possession processes issued by the Family Courts of Lima, with a sample of seven (07) lawyers specialized in family law and ten (10) sentences handed down in possession proceedings by the Family Courts of Lima; Meanwhile, the data collection techniques to be used will be the directed interview and documentary analysis, and its instruments, the interview guide and the legal case analysis sheet; From which, the necessary information will be collected in order to comply with the research objectives and hypotheses.
