Pretrial detention is legally considered as a precautionary, personal coercive measure, through which the accused is deprived of one of their fundamental rights: freedom, which is why the present study aims to analyze this precautionary measure in Latin America (Colombia, Chile and México) that would be violating the principle of presumption of innocence and at the same time far from being an exception has been treated as a rule. The information collected has been from the database of scientific journals such as: EBSCOhost, ProQuest, Scielo and Redalyc. We have chosen the systematic review of the literature for the years 2009 to 2019 and for journals in Spanish for their amount of research. The main question was asked: Does preventive detention violate the principle of the presumption of innocence? To this end, the relationship between preventive detention and the principle of presumption of innocence has been raised using the qualitative method, the value proposal defined in this research is for the last 10 years what allows us to have updated information on the treatment of the figure of preventive detention in Latin American countries such as: Colombia, Chile and México what would justify the presentinvestigation.
