ABSTRACT The present investigation makes an analysis regarding the incidence of the eighteen fundament contained in the binding sentence Huatuco in the state workers’ replenishment processes who previously obtained judgment with res iudicata on denaturalization of their civil or under modality labor relationship, so at the issuance of precedent Huatuco they were already permanent workers. In that sense, a doctrinal analysis of all the legal institutions involved was carried out. Thus, the theoretical framework chapter includes six important items: principles of labor law, the sources of law, recruitment methods, recruitment regimes in the public sector, res judicata and the analysis of the binding precedent Huatuco. On the other hand, cases involving the replacement of workers in the public sector who had a res judicata judgment on denaturalization of their employment relationship before the issuance of the precedent were studied, analyzing two types of processes: those of denaturation before the precedent and those of replenishment after the precedent; evidencing the violation of rights. Finally, interviews with experts in Labor Law and Labor Procedural Law were developed, seeking opinions on the possible existence of a negative impact of the Huatuco’s 18 fundament, in the case presented; all of which allowed the corroboration of the results and the accreditation of the hypothesis raised.
