ABSTRACT By the current investigation, it has been examined the interpretation of the fair and equitable treatment clause of the Bilateral Investment Treaty given by the arbitrators from the International Centre of Investment Settlement Disputes (from now on, ICSID), which may allow be given a guideline based on the interpretation’s criteria of the clause quoted above. Taking the ICSID’s arbitral awards as a baseline for analysis, it has been seeked to present the interpretation’s criteria for knowing how the mentioned clause has been interpreted in the latinoamerican cases, due to, at the level of doctrine, this clause does not rule a concrete definition of the fair and equitable clause, and, even more, the ICSID’s arbitrators interpretation’s criteria is totally different in each case, being impossible to find a common ground to be applied in each opportunity a case arise. During the developtment of the current investigation, has been proposed as the first chapter develop on Bilateral Investment Treaties, because I consider important to establish a general framework prior to delve into the clause fair and equitable treatment and correctly identify the criteria for interpreting. The second chapter addresses the criteria for the interpretation of the clause of fair and equitable treatment, this chapter generally develops interpretive criteria often applied to the development of resolutions or arbitration awards. The third chapter concerns the ICSID’s arbitrators functions related to the International Centre for Settlement of Investment Disputes, this chapter bring us to the development of international conflicts, which are the origins of the claims before ICSID. It is therefore, in this research is confronted with a non-probabilistic sample, at the discretion of the investigator that contrasted with the doctrine and the opinion of five specialists, will allow me to conclude on criteria to be followed by the arbitral tribunal to interpret the clause of fair and equitable treatment in cases concerning investments.
