Contingencias que genera la informalidad laboral en la empresa Urbina Cargo y Encargo E.I.R.L. en la ciudad de Trujillo, 2017

Abstract

RESUMEN En la presente investigación se busca determinar las contingencias que genera la informalidad laboral en la empresa Urbina Cargo y Encargo E.I.R.L. dedicada al traslado y reparto de productos de belleza tales como: talcos, colonias, perfumes, entre otros productos y dirigida a diferentes destinos nacionales. El diseño de investigación es no experimental transversal descriptiva propositiva, por lo tanto se analizan y describen las contingencias que genera la informalidad laboral en la empresa con el objetivo de detectarlas para brindar una solución y una propuesta de mejora a la entidad. Para realizar el desarrollo, se accedió a la información de la empresa, empezando con una entrevista al titular gerente, quien brindó los datos e información necesaria con respecto al registro de planilla, y documentación relacionada al área laboral de la empresa, adicionalmente se realizó el análisis documental pertinente con el objetivo de facilitar la comprensión de todo lo previsto, plasmándose de esta manera en las fichas documentarias. Con dicho análisis se detectaron problemas laborales en la empresa como trabajadores que no se encuentran registrados en planilla, por lo tanto no gozan de los beneficios laborales que le corresponden según ley como es el pago de gratificaciones y depósito de CTS, pago de horas extras, registro de trabajadores en ESSALUD y ONP entre otros. Esto podría ocasionar graves sanciones por parte de SUNAFIL Y SUNAT hacia la empresa. Por tal motivo se genera la problemática ¿Cuáles son las contingencias que genera la informalidad laboral en la empresa Urbina Cargo y Encargo E.I.R.L.?, y para dar respuesta al planteamiento del problema se trazaron los siguientes objetivos: analizar las contingencias que originan las infracciones en materia de relaciones laborales cometidas por la empresa, determinar las contingencias que originan las infracciones en materia de seguridad social cometidas por la empresa, identificar las contingencias que causan las infracciones relacionadas con el cumplimiento de las obligaciones tributarias cometidas por la empresa y establecer una propuesta para evitar infracciones laborales y sus posibles contingencias en la empresa, llegando a la conclusión que las contingencias que genera la informalidad laboral en la empresa Urbina Cargo y Encargo E.I.R.L. son las multas, debido al incumplimiento del pago de beneficios sociales a los trabajadores y esto originaría demandas laborales y multas impuestas por retenciones y omisión de tributos. Por tal motivo y para evitar complicaciones se propuso que la empresa formalice a sus trabajadores incorporándolos en planilla y pagándoles sus beneficios sociales que le corresponden según ley.

ABSTRACT In the present investigation, it is sought to determine the contingencies generated by the labor informality in the company Urbina Cargo and Encargo E.I.R.L. dedicated to the transfer and distribution of beauty products such as: talc, colognes, perfumes, among other products and directed to different national destinations. The design of the research is non-experimental, descriptive cross- sectional, so the contingencies generated by labor informality in the company are analyzed and described in order to detect them to provide a solution and a proposal for improvement to the entity. To carry out the development, the company's information was accessed, beginning with an interview with the managing director, who provided the necessary data and information about the payroll record and the documentation related to the work area of the company. In addition, the relevant documentary analysis with the aim of facilitating the understanding of everything planned, reflected in the documentary records. With this analysis, labor problems were detected in the company as workers who are not registered in the payroll, therefore they do not enjoy the labor benefits that correspond to them according to the law, such as the payment of bonuses and CTS deposit, the payment of hours extras, the registration of workers in ESSALUD and ONP among others. This could cause serious sanctions by SUNAFIL and SUNAT towards the company. For this reason the problem is generated What are the contingencies generated by the informality of employment in the company Urbina Cargo and Encargo EIRL ?, And to respond to the approach of the problem, the following objectives were established: to analyze the contingencies that cause the infractions in matter of labor relations committed by the company, determine the contingencies that originate the social security infractions committed by the company, identify the contingencies that cause the infractions related to the fulfillment of the tax obligations committed by the company and establish a proposal to avoid the work infractions and their possible contingencies in the company, arriving at the conclusion that the contingencies generated by the labor informality in the company Urbina Cargo and Encargo EIRL are fines, due to the lack of payment of social benefits to the workers and this would lead to labor lawsuits and fines imposed by retainer taxes and omissions. For this reason and to avoid complications, it was proposed that the company formalize its workers by incorporating them into the payroll and paying them the social benefits that correspond to them according to the law.
