The objective of the investigation was to understand the special criminal responsibility in minors under 14 and 18 years of age who are offenders and the need to regulate the Code of Criminal Responsibility in adolescents. It is a qualitative study that is oriented with the interpretive paradigm, it assumes the hermeneutical design, because it performs interpretations of speeches (interview responses) of the four participants (police, prosecutor and specialists). It is descriptive level; It meets the criteria of credibility, auditability and transferability, since the data is real, it can be applied in other contexts and it will serve as a background in future research. The technique to collect data was the in-depth interview and the instrument, an interview guide. The results of the investigation report that, in the case of criminal actions caused by minors, regarding their treatment, scales of legal intervention should be given to deal with cases from the simplest to the most complex, the latter being acts of crime involving minors, without losing the principle of protecting the minor and seeking reintegration into society from the perspective of applying socio-educational programs and prosocial strategies, since minors are more likely to reinsert themselves socially and are, in compared to adults, who are disadvantaged in terms of their comprehensive training as a person and which is a factor associated with the criminal behaviors caused.
