Análisis del ordenamiento jurídico y los derechos fundamentales de las personas con discapacidad en un gobierno regional del norte del Perú 2021

Abstract

La investigación es de tipo básica y tuvo como objetivo analizar el Ordenamiento Jurídico y los derechos fundamentales de las personas con discapacidad en un Gobierno Regional del Norte del Perú, 2021; a fin de garantizar la Protección de sus Derechos, y verificar si la Oficina Regional de Atención a las Personas con Discapacidad – OREDIS cuenta con los recursos que la ley establece para la atención de este sector vulnerable, conocer su funcionamiento, formalidad y legitimidad. La población y muestra de estudio estuvo conformada por las personas con discapacidad de un Gobierno Regional del Norte del Perú 2021, la técnica que se utilizó para la recolección de datos fue el análisis documental, la que contó con el instrumento denominado ficha resumen, la cual se utilizó para facilitar el estudio del tema, ya que contiene los datos de identificación de la fuente y luego el tema específico. El estudio se apoyó en el método analítico sintético, ya que ha sido realizado mediante un proceso de razonamiento que tiende a reconstruir un todo, a partir de los elementos distinguidos por el análisis; se trata en consecuencia de hacer una explosión metódica y breve, en resumen. Se concluyó que la OREDIS del Gobierno Regional del Norte del Perú, a la fecha no ha podido alcanzar el grado de institucionalidad, en respeto del ordenamiento jurídico vigente; evidenciándose la relevancia de las variables marco normativo y derecho al trabajo a fin de poder contribuir a superar las barreras actitudinales y del entorno que tienen las personas con discapacidad.

The research is basic and its objective was to analyze the legal system and the fundamental rights of persons with disabilities in a Regional Government of Northern Peru, 2021; in order to guarantee the protection of their rights, and to verify if the Regional Office of Attention to Persons with Disabilities - OREDIS has the resources that the law establishes for the attention of this vulnerable sector, to know its operation, formality and legitimacy. The population and study sample were made up of people with disabilities from Regional Government of Northern Peru 2021, the technique used for data collection was documentary analysis, which had the instrument called summary sheet, which it was used to facilitate the study of the topic, since it contains the identification data of the source and then the specific topic. The study was based on the synthetic analytical method, since it has been carried out through a reasoning process that tends to reconstruct a whole, from the elements distinguished by the analysis; it is therefore a question of making a methodical and brief explosion, in summary. It was concluded that the OREDIS of the Regional Government of Northern Peru, to date, has not been able to reach the degree of institutionalism, in respect of the current legal system; evidencing the relevance of the variables normative framework and right to work in order to be able to contribute to overcome the attitudinal and environmental barriers that people with disabilities have.
