The present investigation entitled: “Compensation to civil servants or public servants, for judicial errors generated by complaints in the exercise of their functions. committed against an official or public servant generated by complaints in the exercise of their Lima, 2022”, has as a general objective, to determine if the judicial error is compensable functions. The methodology that was applied, we approach it from a qualitative point of view, using a phenomenological design, we also applied as an evaluation instrument the interview guide made up of 4 semi-structured questions, the same ones that responded to our general objective, as well as to the specific objectives that we had; likewise, the center of study was Compensation to civil servants or public servants, for judicial errors generated by complaints in the exercise of their functions. Lima, 2022. It was concluded that there is a feasibility of indemnifying those affected by judicial errors, but that in practice, it cannot be specified due to several limiting factors within the application of Law No. 24973, among them, that it does not there is a political decision for its real application, both at the level of the Executive and the judicial bodies, since this compensation should come from the fines imposed on the litigants, lawyers and procedural third parties who have incurred in inadequate judicial practices.
