In our country, the need to protect the rights of Children and Adolescents has been emerging, in situations that endanger their integrity by their parents, when the marital relationship is broken and one of the two exercises the possession of the minor, can come to discredit the other through comments, insults, among others; in which the dignity of the minor, her mental integrity, free development of the personality, family life, etc. is affected. (Aguilar Cuenca, 2005). That is why, through this research work, our main objective is to determine if the Parental Alienation Syndrome violates the Rights of the Child and Adolescent and the principle of the Best Interest of the Child, which warrants a regulation that qualifies the SAP as a grounds for review of tenure and visiting regime. Our research is basic or fundamental, because the purpose it seeks is to obtain and compile information, so within our results we can highlight that most of our justice operators consider Parental Alienation as a pathology that must be regulated as a criterion to resolve in tenure processes.
