Abstract: El presente trabajo de investigación tiene como objetivo general determinar el efecto que
tiene la tenencia compartida en el interés superior del niño y adolescente en Trujillo en el
año 2018. Para el cumplimiento del objetivo se realizó un estudio de tipo cualitativo, el
diseño de investigación fue no experimental de tipo descriptivo, las técnicas utilizadas para
la recolección de datos fueron el análisis documental y la entrevista. El análisis documental
permitió recolectar, identificar, categorizar, analizar y describir el contenido de libros,
artículos científicos, doctrina y legislación relacionados al tema de investigación a través
de resúmenes de las categorías relacionados con las variables de estudio, utilizando como
instrumento fichas textuales, y cuadros resumen. La entrevista fue semiestructurada y
realizada a expertos en temas de familia, se realizó a través de preguntas abiertas,
utilizando como instrumento una guía de entrevista.
Entre los principales resultados se encontró que en la tenencia compartida se da maltrato
psicológico, entre ellas el síndrome de alienación parental, ya que la mayoría de rupturas
conyugales fue por violencia familiar, asimismo el no tener un hogar permanente y reglas
claras de conducta, les produce inestabilidad emocional, afectando con ello el derecho al
desarrollo integral del niño y adolescente.
Se llegó a la conclusión que la tenencia compartida vulnera el interés superior del niño y
adolescente afectando su estabilidad emocional y con ello el derecho a su desarrollo
integral.
The present research work has as a general objective to determine the effect that shared tenure has on the best interests of children and adolescents in Trujillo in 2018. To fulfill the objective, a qualitative study was carried out, the research design was non experimental of a descriptive type, the techniques used for data collection were the documentary analysis and the interview. The documentary analysis made it possible to collect, identify, categorize, analyze and describe the content of books, scientific articles, doctrine and legislation related to the research topic through summaries of the categories related to the study variables, using textual cards as an instrument, and summary tables. The interview was semi-structured and conducted with experts on family issues, it was conducted through open questions, using an interview guide as an instrument. Among the main results, it was found that in shared tenure there is psychological abuse, including parental alienation syndrome, since most marital breakups were due to family violence, as well as not having a permanent home and clear rules of conduct, produces emotional instability, thereby affecting the right to integral development of the child and adolescent. It was concluded that shared ownership violates the best interests of the child and adolescent, affecting the right to their integral development.
