Abstract: La presente investigación tiene como fin abordar un tema propio del Derecho Internacional
Público, específicamente, uno referido al Derecho Diplomático, como es el Principio de
Inviolabilidad de Sede Diplomática. Para lo cual, debe indiciarse que existe un conflicto entre dicho
principio y una norma interna como es la Ley de Recintos Diplomáticos y Consulares de 1987
promulgada por el Reino Unido.
Por ello, el presente trabajo determinará la forma en la que la ley de Recintos Diplomáticos y
consulares incide en el Principio de Inviolabilidad de sede diplomática, ante el plausible ingreso del
Gobierno de Reino Unido a las instalaciones diplomáticas de Ecuador, al tener este último, en
situación de asilado al ciudadano holandés Julian Assange.
Siendo así, la investigación se ha desarrollado a través de tres capítulos en el marco teórico, el
primero de ellos referido, estrictamente, al contenido del Principio de Inviolabilidad reconocido y
amparado por la Convencion de Viena sobre Relaciones Diplomáticas de 1961; el segundo
capítulo trata lo referido a la Ley vigente establecida por Reino Unido respecto a los locales
diplomáticos que alberga en su territorio, es decir “Act 1987-Diplomatic and Consular Premises” y
todo los derechos y deberes que a él respectan; y el Tercer capítulo, se basa en el análisis del
caso de Julian Assange, esto es, la concesión de la figura de asilo diplomático y la injerencia de
las figuras abordadas en los primeros capítulos sobre el caso en específico.
Asimismo, se cuenta con el análisis de casos donde se ha vulnerado el principio de Inviolabilidad
de Sede, protegido por al Convención de Viena entre otros tratados internacionales, en países de
américa, donde haya sido como consecuencia de un hacer o no hacer del Estado Receptor;
aunado a ello, se tiene el aporte brindado por abogados peruanos, especialistas en
Derecho Internacional y Diplomático, los mismos que, conjuntamente con la doctrina, esclarecen
aún más las cuestiones sobre el Principio de Inviolabilidad de sede diplomática en el caso de
Julian Assange.
This research has as objective to address a specific issue of Public International Law. Specifically one related to Diplomatic Law, such as the Principle of Inviolability of the Diplomatic entities. To this end, it must be pointed out that there is a conflict between that principle and an internal norm, such as the United Kingdom Law on Diplomatic and Consular Enclosures of 1987. Therefore, the present work will determine the way in which the Law of Diplomatic and Consular Entities affects the Principle of Inviolability of diplomatic headquarters. In the circumstance of the possible entry of the Government of United Kingdom to the diplomatic facilities of Ecuador. Since Ecuador embassy has provided political asylum to Julian Assange, Dutch citizen. Thus, the research has been developed through three chapters in the theoretical framework, the First one refers strictly to the content of the Principle of Inviolability recognized and protected by the Vienna Convention on Diplomatic Relations of 1961; the second chapter deals with the present law established by the United Kingdom with respect to the diplomatic premises that are located in its territory, that is to say “Act 1987 - Diplomatic and Consular Premises“ and all the rights and duties that concern to it; and the third chapter, is based on the analysis of Julian Assange case, that is, the granting of the diplomatic asylum figure and the interference of the figures addressed in the first two chapters on this specific case. There is also an analysis of cases where the principle of Inviolability of premises by the Vienna Convention and other international treaties has been dishonored by American countries. In which, this has been as a consequence of action or absence of action of the Receiving State. Thanks to the contribution made by Peruvian lawyers, specialists in the International and Diplomatic Law, and with the doctrine, this analysis further clarify the questions about the Principle of Inviolability of diplomatic premises in the case of Julian Assange.
