Abstract: RESUMEN
La presente investigación tiene como finalidad demostrar que la Dación en Pago regulada como institución jurídica autónoma en el Código Civil vigente constituye un supuesto de Novación por cambio de Objeto, posición que no es del todo aceptada, ya que causó divergencias entre las Comisiones Reformadora y Revisora, siendo que la primera consideró que su regulación es redundante.
Sin embargo a pesar de la controversia surgida, la Comisión Revisora decidió incluirla en los preceptos del derecho de obligaciones, situación que desató duras críticas por parte de la doctrina contemporánea, haciendo semblanza que las posiciones disímiles se remontan a tiempos pasados.
La conclusión a la que se ha arribado responde a que si bien es cierto la Dación en Pago es un modo de extinguir obligaciones donde acreedor y deudor acuerdan que éste último se libere realizando una prestación diferente a la pactada, no es posible concebir que en ella no se cree una nueva obligación entre las partes, pues al cambiarse el objeto por otro, el único resultado que se puede obtener es la extinción de la primera obligación y la creación de una nueva que la reemplaza, sobre la cual recaen los efectos jurídicos.
Dicha situación es indiscutible por cuanto se cambia uno de los elementos esenciales de la obligación a la cual no se le puede anteponer temas de tradición, o la rapidez que debe existir entre el convenio y la ejecución de Dación en Pago, o hasta la imposibilidad del cumplimiento, como son algunos de los argumentos
de los que defienden la particularidad de dicha figura y por ende su subsistencia en nuestra legislación Civil como tal.
Para sostener la tesis de la Dación en Pago como supuesto de Novación por cambio de Objeto, se ha hecho uso de la teoría de las obligaciones, la del pago, así como las diversas posturas de los Juristas que respaldan nuestra posición, lo que se sopesará con el Derecho Internacional correspondiente a los Países de Sudamérica y Europa que han legislado sobre el tema.
En ese sentido no se encuentra impedimento para aplicar en la Dación en Pago los mismos principios correspondientes a los de Novación por cambio de Objeto, en tanto el cambio realizado en la prestación ocurre de manera expresa, conllevando tácitamente el cambio de una obligación por otra y por ende la extinción de la primigenia.
Con ello no se intenta eludir la normatividad Civil, ni mucho menos forzar una interpretación en contra, sino más bien se trata de explicar que la naturaleza de las cosas es lo que debe reflejarse en las leyes.
En ese sentido y en razón de la trascendencia que significaría la derogación de normas en el Código Civil es que se efectúa la presente investigación, con la intención de aclarar las controversias surgidas a nivel de Comisiones y doctrina, teniendo como propósito demostrar nuestra posición en cuanto al tema.
En lo referente a la justificación teórica de la investigación, se cree relevante en tanto se enriquece el conocimiento dogmático y el contenido y razón de ser de ambas instituciones jurídicas.
Posteriormente y una vez determinado el mismo, se procedió a analizar su ámbito pragmático, siendo este extremo el determinante en tanto es lo que impulsa a la derogación de la norma, en razón de encontramos antes dos instituciones a las que le son aplicables las mismas reglas.
En ese sentido la justificación práctica de la investigación, persigue establecer un criterio uniforme en cuanto a la regulación de extinción de obligaciones por cambio de objeto, que permita establecer los efectos de la misma.
Y que, para la Dación en Pago establecerá los efectos de la extinción de la obligación primigenia, así como los derechos y atribuciones del acreedor de suscitarse controversias sobre la cosa dada en pago sin que se recaiga en incongruencia con la propia definición de la figura, como lo explicaremos más adelante.
ABSTRACT This research is to demonstrate that the regulated Pay Dación as autonomous legal institution in the Civil Code is a course for change Novation Object, position is not entirely accepted, and that caused differences between the Reformer and Reviewing Committees , with the former considered that its regulation was redundant. But despite the controversy, the Review Commission decided to include it in the precepts of the law of obligations, a situation that sparked harsh criticism from the contemporary doctrine, making semblance that dissimilar positions back to the past. The conclusion has been arrived responds to that although the dation in payment is a mode of extinguishing obligations where creditor and debtor agree that the latter is released by performing a benefit than that agreed upon, it is inconceivable that it not create a new obligation between the parties as to change the object for another, the only result that can be obtained is the extinction of the first obligation and creating a new one replaces it, on which bears the legal effects. This situation is indisputable because changing one of the essential elements of the obligation which can not be putting issues tradition, or the speed that should exist between the agreement and the execution of payment in kind, or even the impossibility of compliance, as are some of the arguments of those who defend the particularity of this figure and thus their livelihood in our civil law as such. To support the thesis of the course Dación Pay as Novation by changing object, we have made use of the theory of obligations, the payment, and the various positions of Jurists that support our position, which weigh with international law relating to the countries of South America and Europe that have legislated on the subject. In that sense it is an impediment to the Dación apply the same principles Pay corresponding to Novation for Object change, while the change to happen provision expressly, tacitly leading the change of an obligation by another and hence the extinction of the primitive. This is not intended to circumvent the Civil regulations, much less force an interpretation against, but rather tries to explain that the nature of things is what should be reflected in the laws. In that sense and because of the significance that would mean the repeal of the Civil Code is that this research is done with the intention to clarify disputes arising at committee level and doctrine, with the purpose to demonstrate our position as the subject. With regard to the theoretical justification of research relevant thought as dogmatic knowledge is enriched and the content and rationale of both legal institutions. Then, once given the same, we proceeded to analyze the pragmatic level, this end being the determinant in both is what drives the repeal of the rule, because of two institutions met before you apply the same rules. In this sense, the practical justification of research, seeks to establish a uniform approach regarding the regulation of discharge of liabilities by change of delivery, in order to establish the effects of it. And, for Dación Pay establish the effects of the termination of the original obligation, and the rights and powers of disputes arise creditor of the thing given in payment without relapse into inconsistency with the definition of the figure, as will be explained later
