In recent years, the possibility of accessing Assisted Reproduction Techniques (by its acronym in Spanish, TERAs) has begun to be demanded more frequently, one of the most used modalities being that of surrogacy. For this reason, many laws have begun to consider them within their own internal regulations. Thus, in this research we have focused on the need to justify the regulation of surrogacy cases in Peru, from a fundamental rights perspective. In this way, throughout the investigation, we have been able to verify that the non-regulation of this technique has led to serious restrictions towards the full exercise of fundamental rights, who see their desire to forge a family impossible. In addition, it has been found that several related rights have been affected, such as sexual and reproductive rights, the free development of the personality, the contractual freedom of those involved, etc. Finally, it is concluded that, in view of the fact that surrogacy is not expressly prohibited in Peru, it is necessary to develop a specific regulation on its scope, in order to protect the rights of citizens who resort to this modality to be able to be parents.
