Abstract: El Compliance gubernamental, es un sistema de prevención orientado a implementar programas de cumplimiento normativo a través del compliance regulatorio y anticorrupción para neutralizar las prácticas corruptas y la corrupción de la clase política en el Perú; la insuficiencia normativa que existe en el país para la aplicación y ejecución de mecanismos de prevención, control y sanción en todas las esferas del Estado crea la sensación de impunidad; Por tanto, el objetivo de la investigación es determinar de qué manera la implementación del compliance gubernamental contribuirá a prevenir la corrupción en el Perú y de cuya respuesta depende la reducción del alto índice de corrupción en el aparato estatal.
Para ello, se han seleccionado 40 trabajos de investigación, entre artículos, tesis y documentos normativos obtenidos de los buscadores académicos y portales institucionales referidos a las subcategorías consideradas para el presente estudio, esto es, el compliance regulatorio, el compliance anticorrupción, las prácticas corruptas y la corrupción política. El método utilizado es el enfoque cualitativo, tipo descriptivo, transversal y por su finalidad es básica mediante el análisis del material bibliográfico y de la normativa obtenida. En el trabajo se concluye que urge la implementación del compliance gubernamental para eliminar las prácticas corruptas desde la prevención y en cada uno de los niveles de la institucionalidad.
Government Compliance is a prevention system aimed at implementing regulatory compliance programs through regulatory compliance and anti-corruption to neutralize corrupt practices and corruption of the political class in Peru; the regulatory insufficiency that exists in the country for the application and execution of prevention, control and sanction mechanisms in all spheres of the State creates the sensation of impunity; Therefore, the objective of the investigation is to determine how the implementation of government compliance will contribute to preventing corruption in Peru and on whose response the reduction of the high rate of corruption in the state apparatus depends. For this, 40 research papers have been selected, including articles, theses and regulatory documents obtained from academic search engines and institutional portals referring to the subcategories considered for the present study, that is, regulatory compliance, anti-corruption compliance, corrupt practices and political corruption. The method used is the qualitative approach, descriptive, cross-sectional and its purpose is basic through the analysis of the bibliographic material and the regulations obtained. In the work it is concluded that the implementation of government compliance is urgent to eliminate corrupt practices from prevention and at each of the institutional levels.
