The omission of family assistance is a relevant problem faced by today's society, before this the State fulfilling its protective and guaranteeing function of the right to food of children, organizes the response of the penal system, based on criteria of reasonableness and efficiency, issuing and applying Legislative Decree No. 1194, which includes the aforementioned crime in the immediate process. Faced with this situation, this study sought to determine the legal effectiveness of the immediate process in the crime of omission of family assistance in the Tembladera Law Court and Preparatory Investigation, years 2017 - 2018. Considering the descriptive characteristic of the investigation, it was determined a sample of 27 cases in 2017 and 25 cases in 2018, building and validating the document analysis guide used for data collection. As a result of the analysis of the results, it is obtained that of the total of cases attended (52) in the two years studied, 32 were referred to the Court of Contumazá, 15 accepted the Principle of Opportunity and 05 to the early termination of the process. For this reason, it is affirmed that the immediate process is legally effective for cases of omission of family assistance.
