The smart contract is a self-executing program code made with blockchain technology according with the conditions set by the programmer. However, it is used without fulfilling the requisites of the legal act, while others don’t even consider them a contract. That’s why we look to analyze the similitudes between the smart contract and the contract as a legal act in the peruvian legislation to analize its applicability in our country. With that in mind, we have made a qualitative and basic investigation of thirty two documents reviewed with the documental analysis technique, which were studied with the phenomenological and hermeneutical method reinforced with three interviews to experts, finding as the main result was the consensus between authors to consider the smart contract as another medium in which the contract is made. With this in mind, we concluded that the technology can be used with the current laws for the legal act but, in the long term, it needs a dedicated norm so the users can be protected by the law.
