Before the update of article 6-B of Supreme Decree No. 009-2019 to the regulation of Law 30364 where it establishes the inadmissibility of any negotiation mechanism between the parties, the objective of the investigation was to establish the socio-legal effects it generates the inapplication of the principle of opportunity in acts of violence against women and members of the family group, research of qualitative approach and non-experimental design for which the doctrine, antecedent of similar studies, interviews with prosecutors of the Fiscal District were addressed of Cajamarca. From the interviews with prosecutors it was obtained that the incorporation of the article under study does not contribute to the reduction of violence against women and the members of the family group, in the same way rights and principles are violated, they also indicated that the workload has increased due while they take time to resolve because they have to submit to trial. Finally, it is concluded that the socio-legal effects are: the disarticulation of the family group, increased procedural burden. It is also determined that what is prescribed in the article under analysis does not contribute to reducing and eradicating violence against women and that rights are affected.
