The present research work is based on the judicial problem of infractions to the regulations of article 911 of the Civil Code, thereby affecting the possessor and the procedural economy. For its development, the theoretical review was considered as a secondary source of the legal foundations of the judicial sentences for eviction demands in the first and second instance, applying software for qualitative research, as well as different legal information (jurisprudence, national doctrine, foreign, legislation ) and national and foreign investigations. It has been demonstrated that the justification of the sentences focuses on the valuation of the property documents, when the right discussed is possession, as well as it was shown that 100% of the sentences appealed to the second instance were formulated by non-conformity the fundamentals that do not generate predictability, leading to an increase in procedural time from 1 to 2 years, thus affecting the procedural economy of the parties, mainly the holder and the state. In this sense, the review by the jurisdictional body has been recommended, in order to consider the application of the predictability of the judgment in the issuance of sentences, in application of criteria established in other judged sentences, so that these legal grounds are referred in application of the new sentence in consideration of the procedural economy, leading to the reduction of procedural times and therefore reduce the procedural burden in the second instance.
