La incidencia de la informalidad en materia de seguridad y salud en el trabajo respecto a las operaciones de las empresas carboneras del distrito de Huanchaco de la provincia de Trujillo

Abstract

RESUMEN En el Perú, existe gran preocupación por parte de la población en cubrir sus necesidades básicas y las de sus familias, lo que ocasiona en algunos casos aceptar o realizar actividades que vayan en contra de su salud. Sucede pues que, en el año 2014 los pobladores del Distrito de Huanchaco denuncian ante la Oficina Defensorial de La Libertad de la Defensoría del Pueblo, las actividades que se realizan en las carboneras del Distrito de Huanchaco, manifestando que estas traen consecuencias graves para su salud y el medio ambiente. En consecuencia, la Oficina Defensorial de La Libertad de la Defensoría del Pueblo y la Fiscalía Especializada en Medio Ambiente en La Libertad, acuden a dicho distrito para corroborar lo señalado por los pobladores y concluyen que efectivamente las labores que se realizan en estas carboneras generar graves consecuencias para la salud de los pobladores y agrava aún más el escenario cuando de dicha visita se percatan que los trabajadores no cuentan con las condiciones mínimas para realizar sus actividades, resultando entonces, la intervención del Gerencia Regional de Trabajo y Promoción del Empleo de La Libertad para la verificación del cumplimiento de la normativa de seguridad y salud en el trabajo. Por lo tanto, ante el escenario descrito, es que se formulan interrogantes respecto a la realidad laboral que afronta un trabajador de una carbonera del Distrito de Huanchaco y se plantean objetivos que busquen en primer término analizar los principios y derechos constitucionales sobre seguridad y salud en el trabajo, asimismo, describir la situación de informalidad en las carboneras del Distrito de Huanchaco, lo cual nos permitirá identificar cuáles son los derechos de seguridad y salud en el trabajo que se encuentran desprotegidos y explicar la relación existente entre la Ley General de Inspección y la Ley de Seguridad y Salud en el trabajo, ya que como se mencionó anteriormente la función inspectiva permitirá supervisar la protección de los derechos de seguridad y salud en el trabajo. Finalmente, en relación a lo planteado es que se desarrollan instrumentos que permitan evidenciar la situación laboral de un trabajador de una carbonera del Distrito de Huanchaco, siendo uno de los más trascendentales, la información obtenida en la Gerencia Regional de Trabajo y Promoción del Empleo de La Libertad en específico a la Sub Gerencia de Inspección de Trabajo, ya que de la información respecto a las visitas inspectivas realizadas a estas carboneras, se demuestra que los derechos a la vida, a la salud y a la dignidad de la persona, se encuentran desprotegidos, como también de lo obtenido en relación a las licencias de funcionamiento otorgadas por la Municipalidad Distrital de Huanchaco y la realización de entrevistas a expertos en seguridad y salud en el trabajo, se obtiene que la informalidad con la que operan estas carboneras, trae como una de las tantas consecuencias que no se realicen denuncias o se manifiesten disconformidad respecto de su centro de labores por miedo a malos tratos o represalias, lo que resulta obstructivo a la labor inspectiva para la protección de dichos derechos.

ABSTRACT In Peru, there is great concern on the part of the population to cover their basic needs and those of their families, which in some cases causes them to accept or carry out activities that go against their health. Therefore, in the year 2014 the inhabitants of the District of Huanchaco denounce before the Ombudsman's Office the activities that are carried out in the bunkers of the District of Huanchaco, stating that these have serious consequences for their health and the environment. Consequently, the Ombudsman's Office and the Environmental Attorney's Office go to that district to corroborate what was said by the villagers and they conclude that the work carried out in these coal mines actually has serious consequences for the health of the inhabitants and further aggravates the scenario when they realize that the workers do not have the minimum conditions to carry out their activities, resulting in the intervention of the Ministry of Labor and Employment Promotion to verify compliance with occupational safety and health regulations. Therefore, given the scenario described, it is that questions are asked about the labor situation faced by a worker from a coal mine in the District of Huanchaco, and the objectives are set out that seek first to analyze the constitutional principles and rights on health and safety in the work also describes the situation of informality in the bunkers of the District of Huanchaco, which will allow us to identify the occupational safety and health rights that are unprotected and to explain the relationship between the General Inspection Law and the Health and Safety at Work Act, since as mentioned earlier the inspection function will allow monitoring the protection of occupational safety and health rights. Finally, in relation to what is proposed is that instruments are developed to show the labor situation of a worker from a coal mine in the District of Huanchaco, one of the most important being the information obtained in the Ministry of Labor and Employment Promotion in specific to the Sub-Directorate of Labor Inspection, Safety and Health at Work, since of the information regarding the inspection visits made to these bunkers, it is shown that the rights to life, health and dignity of the person are of the licenses granted by the Huanchaco District Municipality and interviews with experts in occupational safety and health, in order to demonstrate that the informality with which these coal bunkers operate, brings as one of the many consequences that no denunciations are made or manifests disagreement of their work center for fear of ill-treatment or reprisals, which is obstructive to the inspection work for the protection of these rights.
