ABSTRACT In Peru, there is great concern on the part of the population to cover their basic needs and those of their families, which in some cases causes them to accept or carry out activities that go against their health. Therefore, in the year 2014 the inhabitants of the District of Huanchaco denounce before the Ombudsman's Office the activities that are carried out in the bunkers of the District of Huanchaco, stating that these have serious consequences for their health and the environment. Consequently, the Ombudsman's Office and the Environmental Attorney's Office go to that district to corroborate what was said by the villagers and they conclude that the work carried out in these coal mines actually has serious consequences for the health of the inhabitants and further aggravates the scenario when they realize that the workers do not have the minimum conditions to carry out their activities, resulting in the intervention of the Ministry of Labor and Employment Promotion to verify compliance with occupational safety and health regulations. Therefore, given the scenario described, it is that questions are asked about the labor situation faced by a worker from a coal mine in the District of Huanchaco, and the objectives are set out that seek first to analyze the constitutional principles and rights on health and safety in the work also describes the situation of informality in the bunkers of the District of Huanchaco, which will allow us to identify the occupational safety and health rights that are unprotected and to explain the relationship between the General Inspection Law and the Health and Safety at Work Act, since as mentioned earlier the inspection function will allow monitoring the protection of occupational safety and health rights. Finally, in relation to what is proposed is that instruments are developed to show the labor situation of a worker from a coal mine in the District of Huanchaco, one of the most important being the information obtained in the Ministry of Labor and Employment Promotion in specific to the Sub-Directorate of Labor Inspection, Safety and Health at Work, since of the information regarding the inspection visits made to these bunkers, it is shown that the rights to life, health and dignity of the person are of the licenses granted by the Huanchaco District Municipality and interviews with experts in occupational safety and health, in order to demonstrate that the informality with which these coal bunkers operate, brings as one of the many consequences that no denunciations are made or manifests disagreement of their work center for fear of ill-treatment or reprisals, which is obstructive to the inspection work for the protection of these rights.
