It is not uncommon for the media, in the exercise of freedom of expression, to spread news related to criminal acts, in which they reveal the identity of the alleged perpetrator of the crime, without having established their criminal responsibility, affecting the honor and reputation, especially, because there have been cases in which those accused have been innocent. This situation brings consequently, the collision between two fundamental rights and it was for this reason that the interest in developing this research arose, with the purpose of determining how the collision between the freedom of expression of the media and the right to the human dignity of those detained in flagrante delicto according to national legislation. It was a qualitative, causal explanatory research, with a design based on grounded theory. The results allowed us to conclude that the collision between the freedom of expression of the media and the right to human dignity of red-handed detainees is resolved through the application of the principles of weighting and proportionality, established as a guarantee of fundamental rights in the framework of a Democratic Constitutional State of Law.
