This research aimed to identify the most frequent reasons that led the Tribunal of Sunafil (National Superintendency of Labor Inspection) to penalize service provider companies in Lima during 2021. It was organized according to the methodological guidelines, being of basic type, qualitative approach, and case analysis design, for which the technique and tool used were documentary analysis and documentary analysis guide, respectively, on resolutions issued by the Labor Inspection Tribunal (TFL, for its letters in Spanish), the population consists of the resolutions issued by the TFL of the National Superintendency of Labor Inspection (Sunafil), and obtained from the Intendency of Lima Metropolitana, against service provider companies during 2021. The sample includes 43 resolutions issued by the TFL. The main results indicated that the reasons for which the TFL penalized the service provider companies was the breach of the collaborating role during inspections proceedings and the non-compliance of labor regulations. Likewise, it is noted that the principle of legality is breached by issuing inspection measures of requirement for the irremediable infractions, and that the principle of primacy of reality is breached by not verifying the certainty of the documentation presented by such companies.
