The development of this research is based on a legal phenomenon within the institution of arbitration, which takes place in the violation of the principle of autonomy of arbitration by the filing of the request to set aside the award due to defects of justification before judicial courts. The objective is to carry out a study that determines -based on the application of techniques and instruments for obtaining objective data- in what way the requests to set aside awards for a cause not provided for in the Arbitration Law affects the principle of autonomy of arbitration. Furthermore, it looks to demonstrate that the degree of intervention on the merits in the procedures to set aside an award is considerable, despite the prohibition to decide about it; and that the grounds for setting aside an award due to a faulty justification are the most used, even though they are not expressly regulated. Thus, based on the use of systematic and exegetical legal research methods, the level of involvement in the principle in question is demonstrated. Therefore, this work concludes that the degree of judicial intervention is demonstrable and measurable, violating this principle.
