Las cláusulas amenazadoras al derecho de Autodeterminación Informativa en los Contratos On Line de las redes sociales

Abstract

La presente investigación presenta los problemas de los contratos a través de Internet, debido a que algunas redes sociales vinculadas a contenidos de Internet, lo que en la presente investigación denominamos las cláusulas que amenazadoras al derecho de autodeterminación informativa. Pero, ¿qué derechos pueden ser dañados en una red social? En general las personas que utilizan estas redes sociales son personas naturales que comparten su información personal, esta información que se comparte en Internet, está protegida por un derecho que nuestro tribunal constitucional conoce como derecho a la autodeterminación informativa. Estos nuevos tipos derechos son los que nacieron de los usos de Internet, y el desarrollo de la nueva tecnología, y sería más difícil para protegerlos debido a la fácil accesibilidad y el uso adecuado de Internet. Si estos derechos son difíciles de proteger, por el simple uso de Internet, lo que va a suceder cuando las cláusulas que pretenden vulnerar los derechos a los que las redes sociales tienen acceso (a través de sus contratos on line), dichas cláusulas pretenden dañar nuestro ya mencionado derecho a la autodeterminación informativa. Para evitar esta circunstancia, el presente trabajo se ha propuesto la creación de un organismo internacional que regularice esta situación y resuelva los posibles conflictos a través de los denominados MARCs (métodos alternativos de resolución de conflictos).

The present investigation presents the problems of contracts through internet, because of some social networks linked to internet contents what we call clauses that pretend to damage rights. But, which rights would pretend to cause damage in a social network? In general people who use these social networks are natural people who share their personal information, this information that is shared on the Internet, is protected with a right that our constitutional tribunal know as informative at determinative right. These rights are the new kinds which were born from the uses of the Internet, and the development of technology, and it would be more difficult to protect them because of the accessibility and the proper use of Internet. If these rights are difficult to protect by the simple use of Internet, what is going to happen when the clauses that pretend to damage rights that the social networks use (through their On Line contracts), those clauses pretend to damage informative at determinative rights. For avoiding this circumstance, the present work had proposed the creation of an international organism which would regularize the situations the electronic contracts might present, and resolve the conflicts through what are called MARCs (term used in Spanish for alternative methods for solving conflicts).
