La problemática de la aplicación de la suspensión perfecta de labores en el contexto de la pandemia. Perú, 2020-2021

Abstract

La presente investigación se realizó con el objetivo de determinar la problemática de la aplicación de la suspensión perfecta de labores en el contexto de la pandemia: Perú, 2020-2021. En la metodología se utilizó un enfoque cualitativo, tipo básico con diseño de la teoría fundamentada. Con la vigencia del D.U N°038-2020 se modificaron las condiciones para aplicar la suspensión perfecta, misma que permitía que el empleador suspenda el vínculo laboral con su personal tan solo con presentar declaración jurada al MTPE, sin esperar que esta sea aprobada, lo cual si bien, resultó en parte idóneo para combatir los efectos de la pandemia sobre la economía, esto no fue así respecto a mantener el vínculo laboral entre empleador y trabajador, toda vez que el sector formal se vio afectado el doble, lo cual ocasionó que la cifra de trabajadores informales se incrementaran. En ese sentido, se concluyó que la problemática de la aplicación de la suspensión perfecta de labores en el contexto de la pandemia en el Perú 2020-2021, se debió por una inadecuada redacción y, por ende, una errónea interpretación del Decreto de Urgencia 038-2020, lo que originó incertidumbre respecto de que si existían dos o cuatros supuestos de procedencia.

This research was carried out with the objective of determining the problem of the application of the perfect suspension of work in the context of the pandemic: Peru, 2020-2021. In the methodology, a qualitative approach, basic type with grounded theory design was used. With the validity of D.U No. 038-2020, the conditions to apply the perfect suspension were modified, which allowed the employer to suspend the employment relationship with its staff just by submitting an affidavit to the MTPE, without waiting for it to be approved, which although it was partly ideal to combat the effects of the pandemic on the economy, This was not the case with respect to maintaining the labor link between employer and worker, since the formal sector was affected twice, which caused the number of informal workers to increase. In this sense, it was concluded that the problem of the application of the perfect suspension of work in the context of the pandemic in Peru 2020-2021, was due to an inadequate wording and, therefore, an erroneous interpretation of Emergency Decree 038-2020, which caused uncertainty regarding whether there were two or four assumptions of origin.
