Abstract: Las parejas del mismo sexo en el Perú no pueden contraer matrimonio porque la ley no se los permite. En este trabajo de investigación presentamos los fundamentos jurídicos por los cuales debería modificarse el Código Civil a fin de incorporar en la norma el denominado matrimonio igualitario u homosexual.
Eso de acuerdo a las conclusiones que hemos arribado en base a entrevistas realizadas a juristas peruanos y congresistas que presentaron en el Parlamento los proyectos de unión civil y matrimonio igualitario; al derecho comparado de siete países de la región, y a la revisión documental doctrinal.
Asimismo tomando en cuenta la jurisprudencia nacional, a través de acciones de amparo; y la jurisprudencia de la Corte Interamericana de Derechos Humanos (CorteIDH), específicamente la Opinión Consultiva OC -24/17, que fue tomada en cuenta por cortes de Ecuador y Costa Rica para aprobar el matrimonio entre personas del mismo sexo.
Los derechos que se trasgreden a este grupo históricamente discriminado, son los derechos a la igualdad y no discriminación, derechos patrimoniales como a bienes y herencia; y derechos sociales como los de compartir seguridad social hasta cuestiones básicas como es la toma de decisiones médicas de la pareja en estado de grave, solo por citar algunos ejemplos.

According to the conclusions that we have come to, they are based on interviews that were Made to peruvian jurits and congresspeople that presented in the congress the programs of civil union and the equal marriage; being compared to seven countries of the región, and Also to the doctrinal documentary review. In addition, taking into account the National jurisprudencia, Through the actions of protection; and the jurisprudence of the Inter american human rights court (CorteIDH), especifically the consultive opinion 24/17, that was taken into account by courts of Ecuador and costa Rica to approve the marriage OF people of the same sex. The rights that are transgressed to This historically dicriminated group are; equal right and no discrimination, economic rights such as property and inheritance; and social rights such as sharing safety up to basic matters as the medical decision making of the couple being in serious state of health, just to quote some examples.
