The present research deals with the employment figure of Telecommuting, which originated as a result of technological advances that have been given over the years and have given rise to a novel alternative work, telework, which is considered as the way to work in the XXI century, since it allows to reconcile the personal and professional life of the worker. Teleworking is a new way of working that is specific characteristics of services with the fundamental use of information technology and / or telecommunications that requires no physical movement of the worker to a work center that allows a flexible schedule. However, teleworking to be a reality in our country is not recognized or incorporated in the Peruvian labor regulation which puts at a disadvantage because the teleworker does not have regulated their labor rights, which could be violated by the employer taking advantage the mode of telework in order to avoid their responsibilities and the teleworker abusive treatment, so it is essential and necessary for the Peruvian labor regulation responsive to new changes that have emerged in relation with advances in technology. Teleworking also brings great benefits to the telecommuter as it improves their quality of life, indirectly reduces pollution, allows the inclusion of work by telecommuting and offsets the erroneous idea that telework is a figure that already regulates or has similarities with the work home. However, according to research legal employment status of teleworkers dependent given in compliance with the elements of standard employment contract, as well as the status of job satisfaction of teleworkers in the city of Cajamarca agree that it is satisfied since it gives them many benefits such as flexible schedules, quality of life, etc. However, they conclude that the regulation of telework in the Peruvian labor legislation is unnecessary as it would be established by specific rules governing telework and accurately protect labor rights of teleworkers, since the fact that telecommuting involves making work without the physical presence of the worker at the center of work no longer work. Also, through the study of telework, the determination of the specific characteristics of teleworking and the employment status of the teleworker in the city of Cajamarca, as well as the study of comparative law has been made about the treatment that other countries give figure of telework have granted us the power to issue a draft bill that would recognize and incorporate telework in the Peruvian labor legislation, by which it recognizes: Telework specific features are determined by the contents of the Telecommuting Agreement, and of signs or signals tele-subordination, is recognized labor rights and benefits of teleworking, Labor promotes inclusion of disabled people through the Telework and optimal working conditions conducive to teleworking. Telework, now has an important national and international levels and the elapse of time will be more prominent, in our country telework is a reality, ie there are large numbers of people performing work through teleworking so their study is clearly justified and based on a comparative law study we make a legal contribution through a draft bill that recognizes and incorporates the Peruvian labor regulation to Telework, all in merit to labor law must respond and protect the new work alternatives such as telework legitimized through the regulation of teleworking, implementation and follow-promoting protection of labor rights of teleworkers.
