The present investigation is entitled “The lack of jurisprudential criteria in the sentences that grant compensation for damage to the life project in Peru, 2021“. In this sense, it is focused on the criteria that judges have to determine the amount of compensation for damage to the life project, an investigation that consists of four chapters that are the following: In chapter I, the introduction of the research work is developed, starting with the problematic reality, the national and international antecedents, the analysis of Comparative Law, the regulation of the damage to the life project in the Peruvian Civil Code, later they are cited to several authors and doctrinaires, proceeding to select the investigations that define personal damage, damage to the life project and, above all, the jurisprudential criteria, and quantification. In chapter II, the methodological part is developed, being a basic research, with a qualitative approach, non-experimental design and explanatory level, where the documentary analysis of sentences issued by the Judicial Power is carried out, International Jurisprudence of the Inter-American Court of Human Rights, the analysis of the judgments of the Constitutional Court on the due motivation of the judicial resolutions in the granting of compensation for damage to the life project, and finally the interviews with 05 experts in the field of constitutional law, right civil, and civil responsibility. In Chapter III develops the results of the research work, which are obtained from selected research instruments and techniques; to move on to chapter IV of discussion and conclusions, where it is evident, a problem when determining the conceptualization of the damage to the life project, and therefore also the determination of the compensation quantum, since there are no uniform criteria that must be taken into consideration. magistrates face this type of damage, so this research work is aimed at providing an ideal solution to this problem that has worsened over time.
