El artículo 396 del Código Civil Peruano, modificado por Decreto Legislativo 1377, y su incidencia en el Derecho a la Identidad Biológica y el principio del interés superior del niño

Abstract

La presente tesis, tiene por objeto estudiar los alcances del Artículo 396 del Código Civil Peruano, recientemente modificado por el Decreto Legislativa N° 1377, de fecha 24 de agosto de 2018, sobre presunción de paternidad de hijo extramatrimonial de mujer casada, donde mediante análisis bibliográfico, análisis de casos y entrevistas a magistrados se llega a la conclusión que en la practica el mencionado artículo vulnera el principio del interés superior del niño y el derecho a la identidad del hijo nacido dentro del matrimonio ; toda vez que existe una restricción por parte de la norma en contra del padre biológico a reconocer voluntariamente a su menor hijo.

The purpose of this thesis is to study the scope of Article 396 of the Peruvian Civil Code, recently modified by Legislative Decree No. 1377, dated August 24, 2018, on the presumption of paternity of an extramarital child of a married woman, where by analysis Bibliography, case analysis and interviews with magistrates conclude that in practice the aforementioned article violates the principle of the best interests of the child and the right to identity of the child born within the marriage; since there is a restriction on the part of the norm against the biological father to voluntarily recognize his youngest son.
