Family law is one of the most recognized and treated branches of law in the legal world, this is because it is intended to guarantee adequate measures for the well-being of each member of the family nucleus. In order to contribute to the improvement of our regulatory framework, in this thesis we will analyze the judicial process known as “Reduction of maintenance“ and the special requirement to be admitted before a Jurisdictional Body, stipulated in article 565-A of the Civil Procedure Code. In this sense, in the first part, we will describe the problematic reality to later detail the methodological framework that will be used to prepare this work and the process we use to collect the information. Ending with our results that will later be used in the discussion part, the same that will be given based on our general objective of determining what are the consequences of the regulation of article 565-A of the Civil Procedure Code against the right to Jurisdictional Protection Effective of the obligor, by requiring him to prove that he is up to date in the payment of alimony as a requirement of admissibility in the food reduction processes.
