Los criterios idóneos para determinar el quantum alimentario a partir del expediente 02112-2021-0-1601-JP-FC-02; tramitado en el Segundo Juzgado de Paz Letrado de Familia de La Libertad

Abstract

La investigación surge a causa y consecuencia de la problemática de la determinación del quantum alimentario, teniendo como partida los criterios usados a partir del expediente 02112-2021-0-1601-JP-FC-02; tramitado en el Segundo Juzgado de Paz Letrado de Familia de La Libertad, teniendo como objetivo principal Determinar si los criterios usados por el Juez del Segundo Juzgado de Paz Letrado de Trujillo para determinar el quantum alimentario en el expediente judicial 02112-2021-0-1601-JP-FC-02 son idóneos, se ha empleado como metodología un enfoque cualitativo teniendo un diseño teórico descriptivo. Asimismo, se ha usado la entrevista y el análisis documental como técnica de recolección de información, lo que nos ha permitido obtener como resultado que los criterios usados por el Juez de instancia son idóneas para cuantificar la pensión alimenticia concluyendo que dichos criterios son idóneos y que además se ajustan a los establecidos por la Corte Suprema.

The investigation arises from the cause and consequence of the problem of determining the food quantum, taking as its starting point the criteria used from file 02112-2021-0-1601-JP-FC-02; processed in the Second Justice of the Peace Family Lawyer of La Libertad, with the main objective of determining whether the criteria used by the Judge of the Second Justice of the Peace Lawyer of Trujillo to determine the food quantum in judicial file 02112-2021-0-1601 -JP-FC-02 are suitable, a qualitative approach has been used as a methodology having a descriptive theoretical design. Likewise, the interview and documentary analysis have been used as an information collection technique, which has allowed us to obtain as a result that the criteria used by the trial judge are suitable for quantifying the alimony, concluding that said criteria are suitable and that They also conform to those established by the Supreme Court.
