Abstract: El objetivo del estudio fue analizar cómo la prisión preventiva vulnera los derechos fundamentales del procesado en la legislación peruana, 2021. La metodología usada fue de enfoque cualitativa, de tipo básica, con un nivel descriptivo. La población objeto de estudio se consideró finita por cuanto se conoce el número exacto de los elementos a analizar y la muestra fue no probabilista puesto que se escogió los elementos más idóneos y no se aplicaron técnicas estadísticas. Las unidades de análisis que se tomaron fueron: artículos científicos, jurisprudencia, expedientes judiciales y abogados especialistas. Las técnicas usadas para la recolección de datos fueron la entrevista, el análisis documental y los instrumentos utilizados fueron el guion de entrevista y la ficha de análisis documental. Se concluye que, la aplicación de la prisión preventiva en los procesos judiciales actuales no cumplen con los criterios establecidos en las disposiciones contempladas en la Constitución Política del Perú y en el Código Procesal Penal, al no ser aplicada como un mecanismo excepcional debido al uso excesivo que realizan los órganos jurisdiccionales sin tomar en cuenta los principios de razonabilidad, proporcionalidad y legalidad exigidos por la Corte Interamericana de Derechos Humanos, vulnerando derechos fundamentales tales como la libertad personal, la dignidad humana y las reglas del debido proceso.
The objective of the study was to analyze how preventive detention violates the fundamental rights of the accused in Peruvian legislation, 2021. The methodology used was of a qualitative approach, of a basic type, with a descriptive level. The population under study was considered finite because the exact number of elements to be analyzed is known and the sample was non-probabilistic since the most suitable elements were chosen and statistical techniques were not applied. The units of analysis that were taken were: scientific articles, jurisprudence, court records and specialist lawyers. The techniques used for data collection were the interview and documentary analysis, and the instruments used were the interview script and the document analysis sheet. It is concluded that the application of preventive detention in current judicial processes does not meet the criteria established in the provisions contemplated in the Political Constitution of Peru and in the Criminal Procedure Code, as it is not applied as an exceptional mechanism due to excessive use carried out by jurisdictional bodies without taking into account the principles of reasonableness, proportionality and legality required by the Inter-American Court of Human Rights, violating fundamental rights such as personal freedom, human dignity and the rules of due process
