Abstract: El objetivo de la presente investigación fue analizar la validez probatoria del informe pericial en los delitos de violencia sexual contemplados en la legislación penal peruana, Lima, 2020. La metodología usada fue de tipo cualitativa, con un nivel de investigación descriptivo y de tipo básica. En cuanto a la población se consideró finita por cuanto se conocía el número exacto de los elementos a analizar y la muestra fue no probabilista puesto que se escogió los elementos más idóneos y no se aplicaron técnicas estadísticas. Las unidades de análisis escogidas fueron artículos científicos, trabajos de investigación, normas jurídicas vigentes y sentencias de los tribunales especializados. La técnica usada para la recolección de datos fue el análisis documental y el instrumento utilizado fue la ficha de análisis documental. Aplicado el instrumento y analizada las fuentes primarias se concluyó que el informe pericial es una prueba documental sometida a las mismas reglas de promoción y evacuación de pruebas que otros medios probatorios, con la particularidad de que ésta debe ser potestativa para el juez, tomando en cuenta la racionalidad de los hechos contemplados y debe ser debidamente motivada en forma oral por el perito que realizó la experticia médico legal a la víctima.
The objective of this research was to analyze the probative validity of the expert report on crimes of sexual violence contemplated in Peruvian criminal law, Lima, 2020. The methodology used was qualitative, with a descriptive and basic research level. Regarding the population, it was considered finite because the exact number of elements to be analyzed was known and the sample was non-probabilistic since the most suitable elements were chosen and statistical techniques were not applied. The units of analysis chosen were scientific articles, research papers, current legal regulations, and judgments of specialized courts. The technique used for data collection was documentary analysis and the instrument used was the document analysis card. Applying the instrument and analyzing the primary sources, it was concluded that the expert report is documentary evidence subject to the same rules of promotion and evacuation of evidence as other evidence, with the particularity that it must be optional for the judge, taking into account the rationality of the facts contemplated and must be duly motivated orally by the expert who carried out the medical-legal expertise on the victim.
